Terms of Service for EmailToFuture

1. Introduction

Welcome to EmailToFuture. These Terms of Service ("Terms") govern your access to and use of EmailToFuture's website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

EmailToFuture is a service that allows you to create time capsules — messages scheduled for delivery to yourself in the future. We strive to provide a secure, reliable platform for this purpose.

2. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Eligibility

You must be at least 13 years old to use EmailToFuture. If you are under the age of digital consent in your country (which may vary between 13 and 16), you must have permission from your parent or legal guardian, and they must review and agree to these Terms on your behalf. By accessing or using the Service, you represent and warrant that you meet the minimum age requirements and, if applicable, have obtained any required parental or guardian consent.

4. Account Registration and Security

To use our Service, you need to create an account using your email address or by signing in through Google. You are responsible for:

• Providing accurate and complete information when creating your account
• Maintaining the security and confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You can manage your account in Account settings, including changing your sign-in email or password, signing out other sessions, managing the mobile app waitlist, and scheduling account deletion. If you change your sign-in email, pending time capsules addressed to you as the owner will be delivered to the new address after you confirm the change; additional recipients and already-delivered capsules are not updated. Google sign-in continues to use your linked Google account even if you set a password or change your EmailToFuture sign-in email.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

5. Description of Service

EmailToFuture allows you to create time capsules — messages scheduled for delivery to yourself and other recipients at future dates of your choosing. Key features include:

• Creating time capsules for your future self
• Sending time capsules to multiple recipients (up to 10 recipients per time capsule)
• Setting delivery dates for your time capsules
• Attaching files to your time capsules (images, videos, audio, and documents)
• Storing and managing your time capsules
• Deleting scheduled or delivered time capsules from your dashboard
• Adding reflections to delivered time capsules

When you send a time capsule to multiple recipients, each recipient will receive the same message content at the scheduled time. Recipients will be notified of the sender's email address to ensure transparency about who scheduled the time capsule.

While we strive to ensure timely delivery of your time capsules, we cannot guarantee exact delivery times due to factors beyond our control, such as email service provider limitations, server issues, or internet connectivity problems.

Time Capsule Deletion

You can delete your scheduled or delivered time capsules at any time from your dashboard. Please note:

• Scheduled time capsules: Deleting a scheduled time capsule will prevent it from being delivered to all recipients.
• Delivered time capsules: Deleting a delivered time capsule removes it from your dashboard but does not affect messages already received by recipients.
• Email deletion is permanent and cannot be undone.
• We maintain deletion logs for administrative and security purposes. These logs contain time capsule metadata (such as time capsule ID, user ID, creation timestamp, scheduled date, deletion timestamp, recipients, content length). No actual message content is stored in these logs.

File Attachments

You can attach files to your time capsules. Please note the following:

• Supported file types: Images (JPEG, PNG, GIF, WebP), videos (MP4, MOV, AVI, WebM), audio (MP3, WAV, OGG, M4A), and documents (PDF, TXT, DOC, DOCX).
• Size limits: Maximum 20MB per file, up to 5 attachments per time capsule, with a total limit of 20MB per time capsule.
• Retention period: Attachments are stored for 90 days after time capsule delivery, then automatically deleted. You will receive a reminder before deletion.
• Free during beta: The attachments feature is currently free for all users during the beta period. We may introduce limits or premium tiers in the future.
• Content responsibility: You are solely responsible for ensuring you have the right to share any files you attach, and that they comply with applicable laws and these Terms.

6. User Content

"User Content" refers to any content you create, upload, or provide through the Service, including email content. You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and the consequences of sharing it. By submitting User Content, you represent and warrant that:

• You own or have obtained all necessary rights to the User Content
• Your User Content does not and will not violate these Terms or applicable laws
• Your User Content does not infringe upon the rights of any third party

7. Prohibited Activities

When using our Service, you agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Create or submit content that is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable
• Send unsolicited or unwanted emails to recipients who have not consented to receive them
• Add email addresses to your recipient list without proper authorization from the email address owner
• Use the multiple recipients feature for spam, marketing, or commercial purposes
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks
• Use any robot, spider, or other automated device to access the Service
• Transmit any viruses, malware, or other malicious code
• Upload attachments containing illegal, copyrighted, or harmful content
• Use the attachment feature to circumvent size limits through multiple emails
• Engage in any activity that could disable, overburden, or impair the proper working of the Service

When adding recipients to your time capsules, you are responsible for ensuring you have permission to send them time capsules and that the content is appropriate for all recipients.

8. Service Limitations and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

We may impose limits on certain features or restrict your access to parts or all of the Service without notice or liability if we believe you are in breach of these Terms or if your use of the Service poses risk to EmailToFuture, other users, or third parties.

9. Privacy

Our Privacy Policy, available at Privacy Policy, describes how we collect, use, and share information about you when you use our Service. By using the Service, you agree to our collection, use, and sharing of information as described in the Privacy Policy.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by EmailToFuture and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Service, or our trademarks, logos, or other brand features.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may schedule deletion of your account at any time from Account settings. Deletion includes a 7-day grace period during which you may cancel. While deletion is scheduled, your account is read-only. After the grace period ends, your account and associated data (including undelivered time capsules, reflections, and attachments stored on our servers) are permanently deleted and cannot be recovered. Pending time capsules will not be delivered. Emails already delivered to recipients cannot be recalled. You may also contact us at support@emailtofuture.com for assistance.

12. Limitation of Liability

To the maximum extent permitted by law, EmailToFuture and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

13. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. EmailToFuture expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

EmailToFuture makes no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Emails will be delivered at the exact scheduled time
• Any errors in the Service will be corrected

Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data that results from the download of any such material.

14. Indemnification

You agree to defend, indemnify, and hold harmless EmailToFuture and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

15. Governing Law

These Terms shall be governed by the laws of Slovakia, without regard to its conflict of law principles. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Slovakia.

Nothing in this section will preclude either party from seeking injunctive relief in any jurisdiction to protect its intellectual property rights.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

17. Third-Party Services

Our Service may integrate with or contain links to third-party websites or services that are not owned or controlled by EmailToFuture. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

These third-party services include:

• Google authentication services
• Resend API for email delivery
• Supabase for database services
• Cloudflare R2 for attachment storage

You acknowledge and agree that EmailToFuture shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EmailToFuture regarding our Service and supersede all prior agreements and understandings, whether written or oral.
